1. Introduction
These Terms of Service ("Terms") govern your access to and use of Mirkaso ("Platform", "we", "us", "our"), a crypto analytics and market intelligence platform operated by Mirkaso. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
2. Definitions
- Platform — The Mirkaso website, applications, APIs, and all related services.
- User — Any individual or entity that accesses or uses the Platform.
- Subscription — A paid plan granting access to tiered features (Starter, Trader, Investor).
- Tier — Subscription level: Starter (free), Trader ($25/mo), Investor ($33/mo).
- Content — All data, signals, charts, reports, and analytics provided on the Platform.
- Signals — Automated alerts and indicators based on market data analysis.
- OI — Open Interest, a metric tracking outstanding derivative contracts.
3. Eligibility
You must be at least 18 years old to use the Platform. By registering, you represent and warrant that you meet this age requirement. You also represent that you are not located in a sanctioned jurisdiction and are not prohibited from using financial services under applicable law. We do not knowingly collect data from anyone under 18.
4. Account Registration
To access certain features, you must register an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials. You may not create multiple accounts to abuse free tiers or circumvent limits. We reserve the right to suspend accounts suspected of fraud or abuse.
5. Subscription & Billing
- Subscriptions auto-renew unless cancelled before the renewal date.
- Trial period: 3 days. You will be billed automatically after the trial unless cancelled.
- Grace period for failed payments: 72 hours. After this, access is downgraded to Starter.
- Refund policy: 14 days from purchase if you have not materially used the service.
- Price changes: We will notify you at least 30 days in advance.
- All payments are processed through PayPal in USD.
6. Tier Features
Features are divided into tiers as described on our Pricing page. Starter includes basic market data. Trader adds signal scanner, OI terminal, and position calculator. Investor adds divergence detection, on-chain metrics, and custom portfolio models. We may adjust features with 30 days notice.
7. Not Financial Advice
Critical: Mirkaso provides data analytics and market intelligence, not investment advice. All signals, metrics, insights, and content on the Platform are for informational purposes only. Users make independent trading decisions. Past performance does not guarantee future results. We do not endorse any particular trading strategy. For our full disclaimer, see Disclaimer.
7.1. No Signal Service
Mirkaso is not a signal service, signal provider, or investment advisor. You may not:
- Redistribute, republish, or resell any signals, alerts, or data from the Platform to third parties;
- Use the Platform to operate a competing signal service, Telegram channel, or Discord group that forwards Mirkaso alerts to subscribers;
- Automate trades based on Platform signals without independent verification and risk assessment;
- Represent to any third party that Mirkaso endorses, guarantees, or is responsible for any trading decisions or outcomes.
Violation of this section may result in immediate account suspension without refund and potential legal action.
8. Risk Disclosure
Trading cryptocurrencies involves substantial risk, including the possibility of total loss. Crypto markets are highly volatile. Leveraged trading amplifies both gains and losses. 8.1. Leveraged Trading Warning
If you use leverage in connection with trading decisions informed by Platform data, you acknowledge that leveraged trading can result in losses exceeding your initial deposit. Mirkaso does not display margin requirements, liquidation prices, or leverage risk metrics.
8.2. No Guarantees
Signals and metrics are algorithmically generated and may produce false positives or false negatives. "Accuracy" scores reflect historical backtest performance, not future predictive power.
9. User Conduct
You agree not to:
- Reverse engineer, decompile, or scrape the Platform
- Share your account credentials or allow others to use your account
- Use the Platform for market manipulation or illegal activities
- Resell, redistribute, or commercially exploit Platform data without authorization
- Interfere with or disrupt the integrity or performance of the Platform
10. Intellectual Property
All rights to the Platform, including code, designs, trademarks, and content, are owned by Mirkaso. Users retain ownership of their personal data. By using the Platform, you grant us a limited license to process your data solely for the purpose of providing our services.
11. Data & Privacy
Our collection and use of personal data is described in our Privacy Policy. In summary: we collect account data (email, username), usage data (IP, timestamps), and optional data (portfolio sync, Telegram ID) to provide, secure, and improve our services.
12. Termination
You may delete your account at any time from your profile. Upon deletion, we apply a 30-day grace period during which you may restore your account, after which personal data is permanently erased (payment records retained for 7 years for tax compliance). We may suspend or terminate accounts for violations of these Terms without prior notice.
13. Limitation of Liability
To the maximum extent permitted by law, Mirkaso shall not be liable for any trading losses, indirect damages, lost profits, or consequential damages arising from your use of the Platform. Our maximum liability is limited to the amount you paid us in the last 12 months. This limitation applies regardless of the legal theory asserted.
14. Disclaimer of Warranties
The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee the accuracy, completeness, or timeliness of market data (delays may occur due to API latency). We disclaim all implied warranties, including merchantability and fitness for a particular purpose.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of Spain and the European Union. Any disputes arising out of or relating to these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails within 30 days, disputes shall be resolved exclusively in the courts of Barcelona, Spain.
If you are a consumer resident in the European Union, you may also have access to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
16. Changes to Terms
We may update these Terms with at least 30 days notice for material changes. Continued use of the Platform after changes constitutes acceptance. The "Last updated" date at the top of this page indicates when the Terms were last revised.
