1. General Provisions

1.1. This Acceptable Use Policy (hereinafter referred to as the "Policy") is an integral part of the Terms of Service of the Mirkaso Platform and sets forth the rules, standards, and limitations governing the use of the Platform, its API, data, and services.

1.2. By using the Mirkaso Platform, you agree to comply with this Policy. Violations of these rules may result in suspension or termination of access to the Platform without right to refund.

1.3. In the event of any discrepancies between the Ukrainian and English versions of this document, the Ukrainian version shall prevail.

1.4. The User must comply with the applicable laws of Ukraine, the laws of the User's country of residence, and international law when using the Platform.


2. Permitted Use

2.1. The Mirkaso Platform is intended for the following purposes:

  • Personal analytical use — accessing IT analytical tools, visualizing market data, generating analytical reports for personal needs;
  • Business analytics — using Platform tools for market data analysis in professional activities, including research work and preparation of internal analytical materials for organizations;
  • Educational purposes — using the Platform for educational purposes subject to compliance with all other provisions of this Policy.

2.2. Use of the Platform API in accordance with established limits specified in the documentation and Terms of Service is permitted.

2.3. The User has the right to integrate Platform data into their own analytical systems subject to compliance with API limitations and absence of automated data collection outside the API.

2.4. Distribution of analytical reports generated by the User using the Platform is permitted subject to attribution of the source (Mirkaso).


3. Prohibited Use

3.1. Illegal Activity

Users are STRICTLY PROHIBITED from using the Platform for:

  • any activity that violates applicable laws of Ukraine, the laws of the User's country of residence, or international law;
  • money laundering, financing of terrorism, or other unlawful activities;
  • circumventing sanctions regimes, including OFAC, EU, and Ukrainian sanctions;
  • infringing on the intellectual property rights of third parties.

3.2. Unauthorized Access Attempts

Users are STRICTLY PROHIBITED from:

  • attempting to gain unauthorized access to systems, servers, databases, other users' accounts, or Platform administrative panels;
  • using security scanning tools, exploits, or other methods to discover and exploit Platform vulnerabilities without prior permission (see Security Disclosure Policy);
  • bypassing authentication, encryption, or other Platform security measures.

3.3. DDoS Attacks and Excessive Load

Users are STRICTLY PROHIBITED from:

  • initiating, participating in, or facilitating distributed denial of service (DDoS) attacks;
  • creating excessive load on Platform infrastructure beyond reasonable usage limits;
  • abusing the API by sending an excessive number of requests per unit of time.

3.4. Scraping and Automated Data Collection

Users are STRICTLY PROHIBITED from:

  • using scrapers, parsers, bots, spiders, crawlers, or other automated tools to collect data from the Platform outside the official API;
  • systematically collecting copies of Platform content to create proprietary databases, repositories, or competing products;
  • using automated access frameworks (Selenium, Puppeteer, Playwright, etc.) to interact with the Platform without written permission from Mirkaso.

Exception: Use of the official API in accordance with established limits is permitted.

3.5. Sharing Account Credentials with Third Parties

Users are STRICTLY PROHIBITED from:

  • transferring their account credentials (login, password, API keys) to third parties;
  • allowing other persons to use their account;
  • creating shared or collective accounts;
  • selling, transferring, or renting access to their account.

Each user must have an individual account.

3.6. Use for Market Manipulation

Users are STRICTLY PROHIBITED from using Platform data or tools for:

  • manipulating financial instrument markets;
  • spreading misinformation with the intent to influence the value of financial instruments;
  • coordinated actions aimed at artificial price formation;
  • any activity that violates securities and capital market legislation.

3.7. Spam, Phishing, and Fraud

Users are STRICTLY PROHIBITED from using the Platform for:

  • sending spam or unsolicited commercial messages;
  • phishing attacks aimed at obtaining credentials or confidential information;
  • fraudulent activity of any kind;
  • impersonating another person or representing non-existent organizations.

3.8. Intellectual Property Infringement

Users are STRICTLY PROHIBITED from:

  • copying, reproducing, distributing, selling, or renting any part of the Platform without written permission from Mirkaso;
  • creating derivative products based on the Platform or its data without proper licensing;
  • removing copyright notices, watermarks, or other proprietary rights notices.

3.9. Automated Access Outside API

Users are STRICTLY PROHIBITED from:

  • using bots, crawlers, scrapers, or any automated tools to access the Platform outside the official API;
  • automating interaction with the Platform's web interface;
  • using reverse engineering, decompilation, or disassembly of the Platform's software.

4. API Limitations

4.1. Use of the Platform API is governed by established rate limits, which are specified in the technical documentation.

4.2. The User undertakes to adhere to the principle of fair use when working with the API. This means:

  • sending requests in reasonable volumes necessary to accomplish business tasks;
  • caching API responses to reduce the number of repeated requests;
  • avoiding excessive load on Platform infrastructure.

4.3. API limits may vary depending on the selected subscription plan. Exceeding established limits may result in temporary blocking of API access.

4.4. API keys are confidential information. The User bears full responsibility for safeguarding their API keys and all actions performed using them.


5. Consequences of Violations

5.1. In the event of violations of this Policy, Mirkaso reserves the right to apply the following measures:

5.2. The decision on which measure to apply is made by Mirkaso taking into account the severity of the violation, its consequences, and the User's prior history.

5.3. In the event of account suspension or termination due to a violation of this Policy, fees for the unused subscription period will not be refunded.

5.4. In the event that the Platform suffers damages as a result of a violation of this Policy, Mirkaso reserves the right to seek compensation for damages through legal proceedings.

5.5. Repeated Policy violations, even minor ones, may result in permanent account ban.


6. Reporting Violations

6.1. If you have witnessed a violation of this Policy or discovered suspicious activity related to the Mirkaso Platform, please report it to us:

  • Email: abuse@mirkaso.com
  • Subject: [Abuse Report] Description of violation

6.2. In your report, please include:

  • description of the violation;
  • the account (if known) that is violating the Policy;
  • time and date of the incident;
  • any evidence (screenshots, logs, etc.).

6.3. Mirkaso treats all violation reports confidentially. We reserve the right to report unlawful activity to competent authorities if required by law.


7. Changes to This Policy

7.1. Mirkaso reserves the right to amend this Policy unilaterally.

7.2. The updated version of this Policy becomes effective upon its publication on the website https://mirkaso.com, unless otherwise specified in the updated version.

7.3. Users will be notified of material changes by email at the address specified in their account or through notifications on the Platform.

7.4. Continued use of the Platform after changes have been made constitutes the User's agreement to the updated version of this Policy.
