1. Purpose

This Acceptable Use Policy ("AUP") defines the rules and guidelines for using the Mirkaso platform. By accessing or using Mirkaso, you agree to comply with this policy.

Mirkaso is an educational and analytical platform that provides market data, analytics, and tools for informational purposes only. Mirkaso does not provide financial advice, investment recommendations, or trading signals.


2. Definitions

For the purposes of this AUP, the following terms shall have the meanings set forth below:

  • "Account" means a registered user account on the Mirkaso platform.
  • "Content" means any data, analysis, portfolio information, alerts, or other materials created, uploaded, or generated by a User through the Platform.
  • "Platform" or "Service(s)" means the Mirkaso website, applications, APIs, and all related services provided by the Provider.
  • "Provider," "We," "Us," or "Our" means FOP Haitan Kyrylo Oleksandrovych, operating the Mirkaso platform.
  • "Sanctioned Person" means any individual or entity listed on applicable sanctions lists, including but not limited to the UN Security Council Consolidated List, EU Consolidated Financial Sanctions List, U.S. OFAC Specially Designated Nationals and Blocked Persons List (SDN List), and other applicable sanctions lists.
  • "User," "You," or "Your" means any individual or entity accessing or using the Platform.

3. Permitted Use

Subject to compliance with this AUP and our Terms of Service, you may use Mirkaso to:

  • Access real-time and historical market data, analytics, and indicators for informational and educational purposes
  • Use portfolio tracking, calculation tools, and risk assessment features for personal or internal business analysis
  • Receive market alerts and notifications based on technical indicators and user-configured thresholds
  • Generate AI-powered market analysis and insights, provided such outputs are not presented as financial advice
  • Export data for personal, non-commercial analysis in compliance with API rate limits and fair usage policies
  • Access educational content regarding market analysis techniques and financial literacy

Permitted Use Conditions. All use of the Platform must be (a) in compliance with applicable laws and regulations; (b) consistent with the educational and analytical nature of the Platform; and (c) not infringe upon the rights of any third party. Mirkaso does not provide financial advice, investment recommendations, brokerage services, or trading signals. Any investment decisions made based on Platform data are solely your responsibility.


4. Prohibited Use

You may NOT use Mirkaso to:

4.1 Illegal Activities

  • Violate any applicable laws of Ukraine, the European Union, or your jurisdiction
  • Use the platform for money laundering, fraud, or other financial crimes

4.2 Platform Abuse

  • Exceed API rate limits or scrape data using automated tools
  • Reverse engineer, decompile, or attempt to access the platform's source code
  • Circumvent paywall, access controls, or subscription restrictions
  • Use the platform to distribute malware, viruses, or harmful code

4.3 Data Misuse

  • Resell, redistribute, or sublicense access to the platform or its data
  • Use platform data to manipulate markets or spread false information
  • Access other users' accounts, data, or API keys without authorization

4.4 Content Restrictions

  • Generate or distribute sexually explicit, offensive, or harmful content
  • Use AI features to create misleading or deceptive market analysis
  • Send spam or unsolicited messages through alert systems
  • Harass, threaten, or discriminate against other users

4.5 Financial Misrepresentation

  • Present Mirkaso analytics as financial advice to third parties
  • Use Mirkaso data to make guaranteed return claims
  • Misrepresent the accuracy or completeness of platform data

4.6 Sanctions Compliance

You may NOT use the Platform if you are a Sanctioned Person or if you are located in, or a resident of, any country or territory subject to comprehensive sanctions (including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine).

  • Facilitate transactions or activities that would violate applicable economic sanctions administered by the UN, EU, U.S. OFAC, UK OFSI, or any other relevant sanctions authority
  • Use the Platform on behalf of, or for the benefit of, any Sanctioned Person
  • Attempt to disguise or conceal your identity, location, or beneficial ownership to circumvent sanctions screening

4.7 Export Control

You may NOT use the Platform in any manner that violates applicable export control laws, including but not limited to the U.S. Export Administration Regulations (EAR) and EU Dual-Use Regulation.

  • Export, re-export, or transfer any part of the Platform to any destination, end-user, or end-use prohibited under applicable export control regulations
  • Use the Platform for purposes related to weapons development, nuclear technology, missile technology, or chemical/biological weapons, unless expressly authorized under applicable law
  • Download, install, or access the Platform from jurisdictions where such download or access is prohibited by export control regulations

5. Subscription and Billing

  • All subscriptions are subject to our Terms of Service and Refund Policy
  • Subscription fees are non-refundable except as specified in the Refund Policy
  • We reserve the right to suspend or terminate accounts for violations of this AUP

6. Data and Privacy

  • User data is processed in accordance with our Privacy Policy
  • We do not sell user data to third parties
  • Market data is sourced from third-party providers and provided as-is

7. Account Security

  • You are responsible for maintaining the confidentiality and security of your Account credentials, including your username and password
  • Enable multi-factor authentication (MFA/2FA) when available; you are responsible for maintaining access to your MFA device or backup codes
  • Use strong, unique passwords of at least twelve (12) characters containing a mix of uppercase and lowercase letters, numbers, and special characters

8. Service Availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • Market data may experience delays or inaccuracies due to third-party provider issues
  • We reserve the right to perform maintenance with reasonable notice

9. Intellectual Property

  • Mirkaso branding, software, and content are protected by copyright and trademark laws
  • Users retain ownership of their custom analyses and portfolio data
  • You may not copy, modify, or create derivative works from the platform without authorization

10. Consequences of Violation

Violations of this AUP may result in:

11. Reporting Violations

12. Changes to This Policy

We reserve the right to update this AUP at any time. Changes will be effective upon posting to https://mirkaso.com/legal/compliance. Continued use of the platform after changes constitutes acceptance.

14. Monitoring and Audit Rights

We reserve the right, but are not obligated, to monitor use of the Platform for compliance with this AUP. This includes, without limitation, automated scanning of user-generated content, API usage patterns, network traffic analysis, and account activity review. By using the Platform, you consent to such monitoring.

We may cooperate with law enforcement authorities, regulatory agencies, and third-party rights holders in investigating any suspected violation of this AUP or applicable law. We may disclose any information necessary to satisfy applicable law, regulation, legal process, or governmental request.


15. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT, DATA, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that: (a) the Platform will be uninterrupted, timely, secure, or error-free; (b) the results obtained from use of the Platform will be accurate or reliable; (c) any errors in the Platform will be corrected; or (d) the Platform is free of viruses or other harmful components.


16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PROVIDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (I) THE AMOUNT YOU HAVE PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY; OR (II) ONE HUNDRED U.S. DOLLARS (USD $100).


17. Governing Law and Dispute Resolution

This AUP shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions. Any dispute shall first be attempted to be resolved through good faith negotiations. If unresolved within thirty (30) days, either party may submit the dispute to binding arbitration administered by the Ukrainian Chamber of Commerce and Industry in Kyiv, Ukraine.

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending the resolution of arbitration.


18. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under this AUP to the extent such failure or delay results from causes beyond the reasonable control of that party, including but not limited to: acts of God, war, terrorism, riots, embargoes, fire, floods, earthquakes, epidemics, pandemics, strikes, or failures of telecommunications networks.


19. General Provisions

19.1 Severability. If any provision is held invalid, the remaining provisions shall continue in full force and effect.

19.2 Waiver. No waiver shall be effective unless in writing. Our failure to enforce any right shall not constitute a waiver.

19.3 Entire Agreement. This AUP, together with our Terms of Service, Privacy Policy, Cookie Policy, and Refund Policy, constitutes the entire agreement and supersedes all prior agreements.

19.4 Assignment. You may not assign this AUP without our prior written consent. We may assign this AUP without restriction.

19.5 Third-Party Beneficiaries. This AUP does not create any third-party beneficiary rights.

19.6 Headings. The headings are for convenience only and shall not affect interpretation.


20. Children's Privacy

The Platform is not intended for use by individuals under the age of eighteen (18). We do not knowingly collect personal information from children under 18. If you believe we might have any information from or about a child under 18, please contact us at support@mirkaso.com.


21. Accessibility
